Here's a direct quote from Bud Selig on tampering charges filed in 2004 against...SURPRISE: George Steinbrenner on Randy Johnson, who the Yankees were not involved in direct contact with 'Zona to acquire Johnson. Read the last paragraph quoting Selig.

From the NY Sun and Wallace Matthews:

Right now, the deal Steinbrenner wants to make is to bring Randy Johnson to the Yankees to shore up his tottering pitching staff, the one that even $183 million couldn't fix.And if he has any hope of doing that, he's going to need Bud Selig's blessing.

Over the past week, Steinbrenner - who abhors, rightly, the very concept of the luxury tax Selig jammed down his throat in 2002, and even retained attorney David Boies to explore the possibility of suing MLB - has been overtly jockeying to worm his way into Bud's good graces.

In fact, the kissy-fest has worked both ways. Two weeks ago, Steinbrenner gushed publicly about how much he would "love" to have Randy Johnson, a clear violation of baseball's tampering rules if ever there was one. But there was Selig jumping to the Boss's defense: "You know tampering when you see it... Believe me when I tell you, that is not tampering."

Dan:

"Is it tampering for the Twins to tell the Red Sox that the Yankees just upped their offer to include Hughes, so can you do better?"

No, that's negotiating. The person to be protected is the owner with the player under contract. If Pohlad chooses to share information with other teams to improve his situation, it shouldn't be tampering.

Rebecca - I think it's pretty awesome too. And I'm glad to see that the younger IHHS grads are doing so well--test scores, blogging, etc.

Hunter vs. Cabrera is like Secretariat vs. a farm horse.

I'm not saying Melky will develop into Hunter, however please look at Hunter's first 2 years as a starter in Minny and then look at Melky's first 2 years as a starter in NY.

Melky, at a younger age put up better numbers than Hunter. In fact, it's not even close.

thank you mdog, you have the legal expertise view,, my view was a little more common sensible- no new information by virtue of Hank comments so Twins would have a hard time justifying any damage from the public comments.

Regarding tampering: Why isn't it tampering for a player, such as Jorge and, I just learned, Papelbon, to say that they want Santana on their team? Isn't the player a representative of his team? What if Hank told Jorge to hold a press conference to say, "If I were Hank, I'd give the Twins until Monday night to make up their minds." And then Hank decided to set a deadline? You know that Jorge is stupid enough to allow someone to put him up to something like that.

I'm not saying I know the tampering rule, and I'm sure it's complicated and outcomes are very fact driven. But isn't the tampering rule designed to protect team owners from having player negotiations tainted by offers dangled directly to players without the owners' knowledge, permission and/or a chance to counter the "secret" offer in open, arms-length negotiations?

It seems a bit odd then to talk about tampering when the guy who owns Santana's contract has authorized his GM to enter into face to face negotiations with a number of teams for the purpose of trading the player in question. Santana's agent and Santana know very well who is interested in him. And as far as I can tell, all Hank has said is that he's very interested in acquiring Santana for the right price and that he's not going to be jerked around. Wouldn't that be quite clear to the Twins' owner by now, seeing as they are in the middle of a second or third week of serious negotiations over Santana? How does something that painfully obvious and innocuous give the Yankees an unfair advantage and put the Twins at a disadvantage? In other words, no blood, no foul.
