MLB responds regarding tonight’s 60 Minutes segment

Major League Baseball has responded to the MLBPA statement by issuing a statement of its own:

“We have notified the Major League Baseball Players Association on numerous occasions that we intended to respond to all of the attacks on the integrity of our Joint Drug Program. Those attacks continued yet again yesterday with Mr. Rodriguez’s statement. Out of respect to the grievance process and at the request of the MLBPA, we waited until a decision was rendered to make our response.

“It is ironic that the MLBPA is complaining about MLB’s participation in this program given that Mr. Rodriguez’s lawyer is also participating in the show.

“As to Mr. Bosch’s appearance, he is not controlled by us and is entitled to speak however he chooses about his interactions with Mr. Rodriguez.”

    On a serious note, I remember two behaviors that supposedly give away people who are being deceptive. You might want to check for these:

    1. Rapid eye blinking when answering questions.
    2. Looking down or around when answering, as opposed to looking directly into the eyes of the questioner.

    Y’s Guy – I agree with you that they can’t have it both ways. This should make Upstate happy anyway since he was convinced that MLB wouldn’t want to give up any proof if they had no good evidence. It also tracks with what I said, IMO, that if Arod’s side had a good case, they’d want it out there.

    I think we are already seeing the Union regret their decision to not fight for the JDA in this Alex mess.

    MLB is not going to say “well thanks guy’s we will play nice from now on”. They are going to stick it to the Union any and every chance they get.

    Really indefensible position the Union put themselves in. My only explanation is it’s because someone who was dying let his emotions, instead of his intelligence take over. Understandable on his part, but not for the people who worked for him.

    Iam fine with MLB getting the documents from the drug dealer for their purposes.

    Two things:

    1. Selig should have to suffer for allowing this to go on so long

    After watching this, I dont think anyone comes out looking good. In my opinion, I think baseball took another step back after tonite. Whether it be the prime witness (Bosch) alleging that everyone is pretty much using or that Manfred bought records from ‘Bobby’.

    I think Arod is guilty, but this whole thing was ugly.

    As a friend of mine just said, it was like watching a parade of scumbags (he said another word).

    1. First offense: Void contract if team wants, 1 year ban, 1 year league minimum salary on whatever team signs him

    2. Second offense: Void, 2 year ban, league minimum salary/1 year contracts for remainder of his career

    Well you might not like the distinction, but Melky was caught under the JDA, so he was punished under the JDA. Arod got whacked under the policy that allows the Commissioner to choose the number of games for suspension when a player has either procured or sold PEDs. Plus he added games for Arod’s impeding the investigation.

    How many times was Melky caught?

    Remember, ac1, we now know that Arod admitted using in 2009 and swore he’d never do it again and started up again in 2010 and continued until the Miami newspaper published the story in January of 2013 (I think that’s when the story was published). That’s really a lot more than Melky got caught with, I believe.

    MLB as the governing body is in charge of the integrity of the game and when they are gulty of lacking integrity, that is more dangerous than an individual player lacking integrity.

    Tacopina is definitely sleazy. He makes a point of representing “questionable” clients. Joran van der Sloot was free to murder (again) because Tacopina was successful in defending him. Also defended one of the cops accused of sodomizing Abner Louima.

    Just read a few posts on the previous threads…Also read some tweets about the Arod mess as well as the news reports from the MLBPA and MLB about “60 minutes”

    MLB shouldn’t have done what they did…They should have stayed quiet and let the ruling speak for itself… This intervention rings like they need to justify themselves… That’s never good.

    Also, I feel compelled to support our fellow poster Tar… He never said he was innocent, he just said that it was inherently unfair… I do believe that it was a witch hunt and Arod was unfairly singled out and his punishment disproportionate in relation to other punishments handed to other players.

    Having said the above… I do believe that Arod is far from innocent… And his actions has been questionable at best…He is not only hurting Selig who probably deserves it, but he is hurting the game as a whole, and that shouldn’t be condoned or accepted either… Again, as I said before, this was a fight between to very disingenuous sides… Very hard to pick a side.

    I could never be a union rep, because I would never try to defend a guilty person, other than to make sure his constitutional rights were protected. I’ve had union representatives admit to me in private that they know their client is guilty and then put on a show in the hearing that would be Oscar worthy.

    That’s why I’ve always been a plaintiff attorney and not a defense attorney.

    However, I would never represent a lying plaintiff either or try to represent something other than the truth. My clients know that before I take their cases. I make that crystal clear.

    Some yankee fans have integrity and think the integrity of the game is more important than winning at the expense of players who are playing the game correctly. Some of us are also fully cognizant that there was a sham steroid investigation conducted at fenway in 2009 and Bud Selig and John Henry have been partners in crime for many years.

    They had a set of penalties in place, agreed by both sides ( MLB and MLBPA )… This penalty wasn’t… Which makes it questionable and disproportionate IMO… I am not defending him, but it was unfair

    Spped reading some posts… my 2 cents on the Tanaka tweet. I really have no idea how high the AAV will be on the contract (my guess is a floor of 20). The part of the tweet that I find puzzling is the length. I would think Close would want a length of no more than 7 years so they will have the chance for another pretty large contract at age 32. JMO

    Arbitration usually means that the Union and Management do not have the same interests. And if the Union wants to change the narrative, they should renegotiate the JDA. Not allow one of their own to be unfairly punished.

    And once the bar was pushed, it is a lot harder to get it back. Precedent was sent ( the commissioner can set the punishment, evidence can be collected by any means possible) and MLB is ecstatic that the Union did nothing to stop it.

    I am a physician and believe a lot of what Bosch said about AR’s “protocol” is not true. For example, testosterone used sublingually persists in the blood a lot longer than a few hours!

    I always thought a lawyer was supposed to represent a person accused of something in a court of law, and give him/her the best counsel they could. It’s up to the jury or the judge to determine guilt, not the defense counsel.

    After watching this, I’ve come to the conclusion that for MLB to go to any lengths and bullying Bosch with protection and everything else is pretty shady. The integrity is just thrown out the window in this whole case.

    Just a thought on the testosterone gummies. Testosterone levels apparently are fairly easy to mask and metabolize fairly quickly plus if your natural levels are already low, synthetic testosterone might not raise it to high enough levels to flash any warning signs.

    I’m not refuting the fact that ARod was cheating, but these gummies that he was taking, the size of a sunflower seed, or candy just before game time or an at bat , maybe they were just placebo.

    When I was in law school the head public defender in my state came and talked to us and said that he estimated that 98% of his clients were guilty. Believe it or not, clients actually admit to attorneys that they’ve done wrong. But they still want to get off.

    It’s pretty easy to tell that someone wants you to bend the law when they suggest that you say something that might win the day but isn’t the truth. I have had clients do just that. I lay down the rules before I take the case in the event that someone thinks they have an attorney who is willing to play fast and lose in order to win. Hint: there are many out there that will, and do.

    1. When you’re defending a client that’s your job. That’s why there are plaintiff’s attorneys (the accuser) and defendant’s attorneys (the accused). And by the way, attorneys don’t present cases in a vacuum. They actually have to prepare their cases, and preparing cases relies heavily on the testimony of the client. A lawyer defending the accused is supposed to insure that the person’s constitutional rights are protected, not try every which way but loose to get the client off whether or not the client is innocent. That’s the way it’s supposed to work. That’s not the way it works much of the time.

    But I’m sure you knew that before I even told you that. Do the names OJ Simpson and Casey Anthony ring a bell? Simpson’s lawyers knew he had failed his polygraph miserably but played chicken with the prosecutor’s office and told them they would reveal the results of the test to them only if they would agree to have them presented in court. Naturally they declined. His attorneys still worked vigorously to have him acquitted. That of course went far beyond giving him counsel.

    luis you are woefully misinformed. If you promise to read what I write, I will tell you why. I say this because I have already explained it at least 5 times. I think you’ll better understand what happened after that and probably even feel better about what happened.

    I will tell you that Arod and Tacopina dismissed the union from the case after the union announced that they had recommended that Arod accept an unspecificed number of games as punishment and he refused to do so. The union was not allowed to do anything in the case after that. Tacopina took over at that point and in short order sued everyone but the Statue of Liberty.

    If you want the explanation about why the punishment stipulated in the JDA has no relevance here, I’ll be happy to go into that. Just let me know.

    luis, here’s the thing. The JDA calls for penalties for players who have failed drug tests. On the other hand, the Commissioner has the right to impose any penalty he sees fit for players who have been found to either be selling or in possession of PEDs. So he wasn’t bound by the strictures of the JDA. That said, he did use the recommended 50 games for all of the other “Boschites” except for Braun, to whom he gave 65. MLB apparently believed the evidence from Bosch that showed Arod had been using again starting in 2010. But I think the biggest part of what he got had to do with Arod’s attempting to obstruct the investigation. (I also believe that his dealing with that Dr. in Canada who was busted for giving out steroids, and then Dr. Gross who was busted for the same, was taken into consideration. I think MLB just saw him as a flagrant rulebreaker. But that’s JMO. There’s no evidence that says those things were taken into consideration.)

    Because the union’s interest is usually to stick up for its members. The argument being made is that in this case the union’s interest is not to stick up for players who break the law.

    This is not a matter of legal precedence. This is not a trial. If what MLB did was either not allowed under the CBA or against the law, the union can still prevent it from happening in the future. If it was illegal, of course, A-Rod’s lawyers are going to get that across in court. If it was not allowed under the CBA, it would have already come up in arbitration. I’m really not sure what your point is here. They did something wrong that no one can prove is wrong?

    The difference between calling someone a moron and saying their action is “inexplicable” is just semantics. This is exactly what I was talking about. If you think that smart people are doing something “inexplicable” you are probably missing the explanation. You might disagree with that explanation, but it’s unlikely that smart people would just do something that makes no sense.

    Maybe MLB is trying to justify their actions or sway public opinion. Many fans feel that the 162 game punishment was too severe. I think there is growing fan sympathy for Arod.

    Why would Selig be willing to speak with “60 Minutes” about ARod and decline to testify at the arbitration panel? All this does is taint Selig’s already tarnished legacy.
