Five things to know about the latest A-Rod lawsuit

Alex RodriguezThe Associated Press filed this five-things-to-know list, and it includes some detail about the judge handling the case.

WHAT IS RODRIGUEZ CLAIMING? His lawsuit accused the Major League Baseball Players Association of “bad faith,” said its representation during the hearing was “perfunctory at best” and accused it of failing to attack a civil suit filed by MLB in Florida state court as part of its Biogenesis investigation. His lawyers criticized Michael Weiner, the union head who died from a brain tumor in November, for saying last summer he recommended Rodriguez settle for a lesser penalty if MLB were to offer an acceptable length. The suit claimed Major League Baseball engaged in “ethically challenged behavior” and was the source of media leaks in violation of baseball’s confidentiality rules. It said Horowitz acted “with evident partiality” and “refused to entertain evidence that was pertinent and material.” And it faulted Horowitz for denying Rodriguez’s request to have a different arbitrator hear the case, for not ordering baseball Commissioner Bud Selig to testify and for allowing Biogenesis of America founder Anthony Bosch to claim Fifth Amendment rights against self-incrimination in refusing to answer questions during cross-examination.

WHAT WAS THE REACTION? Former major league All-Star Tony Clark, who took over from Weiner as the union head, issued a statement saying “it is unfortunate that Alex Rodriguez has chosen to sue the players’ association. His claim is completely without merit, and we will aggressively defend ourselves and our members from these baseless charges. The players’ association has vigorously defended Mr. Rodriguez’s rights throughout the Biogenesis investigation, and indeed throughout his career. Mr. Rodriguez’s allegation that the association has failed to fairly represent him is outrageous, and his gratuitous attacks on our former executive director, Michael Weiner, are inexcusable. When all is said and done, I am confident the players’ association will prevail.”

WHAT DID THE ARBITRATOR FIND? Horowitz, in a decision made public as part of the lawsuit, concluded Rodriguez used testosterone, human growth hormone and insulin-like growth factor-1 in 2010, 2011 and 2012 in violation of baseball’s Joint Drug Agreement. He wrote MLB was justified in citing violations of the collective bargaining agreement because Rodriguez “played an active role in inducing Biogenesis of America founder Anthony Bosch to issue his own public denial on Jan. 29″ and “attempted to induce Bosch to sign a sworn statement on May 31″ saying he never supplied the player. Still, Horowitz cut the suspension from 211 games to 162 plus the 2014 postseason.

WHAT’S NEXT? MLB and the union will file answers, and Rodriguez’s lawyers may ask for a preliminary injunction to block enforcement of the suspension, which starts with the Yankees’ season opener on March 31. Rodriguez’s lawyers may attempt to depose Selig and others, but MLB could ask U.S. District Judge Edgardo Ramos to quash any subpoenas. It’s not clear whether the legal process will take weeks or months. Supreme Court decisions have set narrow grounds for judges to vacate arbitration decisions, instances such as corruption or not following the rules agreed to by the parties.

WHAT IS THE JUDGE’S BACKGROUND? Born in Ponce, Puerto Rico, in 1960, Ramos is a graduate of Yale and Harvard Law School. He was an assistant U.S. attorney in Brooklyn from 1992-02, between stints as an associate at Simpson Thatcher & Bartlett, and a partner at Day Pitney, where he was a member of the white-collar and internal investigations practice group. At the U.S. Attorney’s Office, he became deputy chief of the narcotics section. In 2009, he was the court-appointed defense lawyer for Oussama Kassir, a Lebanese-born Swede convicted of 12 charges of plotting to help al-Qaida recruit and then sentenced to life in prison. Ramos served for eight years as commissioner of the New York City Commission to Combat Police Corruption following his appointment by former Mayor Michael Bloomberg. The judge was nominated for the bench by President Barack Obama and confirmed by the Senate in December 2011.

    My friend just brought up a good point. Obviously no one knows the answer to this but when Tanaka was in the US did he visit the yanks in NY? If not and he just stayed in LA then that might not be good news for them. If someone is going to live somewhere for 5 – 7 years you would think that they would first visit where they are going to be. Maybe he plans to come back next week before he agrees to a deal but I doubt it.

    189 is probbaly still possible if they don’t sign anybody else but it sounds like they may have to still move Ichiro to get under …..

    They are kinda doing what they said they’d do all along…..spend right up to the limit and then decided whether it makes sense to go over or not…..seems like they are basing that on Tanaka

    Ichiro is a big money make for the Yankees still although much much he will bring in as a bench player is unknown. If they have to move anyone it would probably be Gardner since he has more trade value. It won’t matter that Gardner is more valuable tot he team on the field because they are going nowhere if they stay under 189.

    Tanaka was in Ny with a group, as a teenager. He just got married to an older 29 yo this offseason. He was in LA solely to have a meeting with some teams and get a physical mainly of his arm . That was last Thursday and Friday and I believe it was Sarurday when he flew back to Japan

    That’s what the rumors seem to indicate. Of course, it could also be a negotiations tactic with some of the other remaining free agents to try to keep their prices down. There was a rumors that they requested Santana’s medicals recently.

    Could be meaningful, but it could also be pretty meaningless. He could have gotten a tour of the Yankees facilities or something if he had come, though you can also kind of assume that a new stadium is state of the art and a lot of their facilities are in Tampa anyway. If he’s been to NYC before there’s not much to wanting to see it before he lives there. If he was meeting with some non-LA/NY teams to see what they were offering he might have just saved himself the hassle of traveling to Seattle, Boston, Chicago, and whatever other places. Make one trip and narrow down the list maybe before traveling all over the country.

    The yanks have a lot riding on Tanaka’s decision. If he signs somewhere else then they are done spending and the team is not going to be that good next year. The starting pitching desperately needs him and it’s obvious that the yanks will not sign anyone else if he doesn’t come.

    Masahiro Tanaka updates from Sunday, January 12, 2014:

    Tanaka returned to Japan on Saturday after spending about fifty hours in Los Angeles — four days, two nights.
    He got a physical and then met with at least six MLB teams.
    Over thirty reporters were at the airport in Los Angeles (he avoided the media by using a separate check-in counter) and Narita (he did not respond to questions by the media).
    The trip to the United States was most likely about getting the physical out of the way to address any concerns teams might have about his health.
    Teams most likely did not present any specific contractual terms during their meetings with him. Discussions likely focused on things like team environment and facilities.
    He will resume him training in the Kanto region until the 17th.

    The report said the Yankees were just doing DD on Santana but typically when a team requests medicals they are at least considering the possibility of a player…..I have heard or read nothing really on his price.

    The goal in trading Ichiro would, in this 189 scenario, be less about the talent return and more about saving a few bucks.

    “It won’t matter that Gardner is more valuable tot he team on the field because they are going nowhere if they stay under 189.”

    I’m still waiting for someone to explain to me how they are a .500 team “going nowhere” right now, but as soon as they add one or two guys they are suddenly this super-awesome contender. Unless they’re adding Mike Trout one guy is not likely to move you from going nowhere to being a serious contender.

    It also still matters how good your team is even if you don’t make the playoffs. There’s a huge marginal difference between making the playoffs and not, but that doesn’t mean that the Yankees will generate the same revenue if they win 65 games as 85 games.

    I want them to get him, but I also think they’ll be fine without him. I expect the rotation to be solid as it stands.

    I think that Ubaldo, Garza and Santana are going to get less money than they thought going into the off season. Supposedly the Angels really like Garza and have talked about a deal if they don’t get Tanaka. As soon as Tanaka signs I expect those other pitchers to sign quickly after.

    You can look these over, ERA, Saves, complete games, etc and make up your own mind if you think the current possible 12 pitchers will be better than last years, now without Rivera , Pettitte, Hughes, etc.

    I think they can be very good with him especially if CC pitches like CC. But without him and if they don’t sign another pitcher I just don’t think the rotation is that good.

    I really can’t either. Let’s see he left Tokyo on Thursday, Tokyo time, landed in LA at 11:50 PM Wednesday , stepped off the plane at 12:05 AM Thursday LA time, met that day and all day Friday with his agent and teams, had a physical also. Saturday he left that morning and when he landed in Tokyo it was now Sunday, and my mistake it’s 11, not 14 hours later, compared with LA.

    Now I’m confused! :)

    I’ll be a little surprised if the negotiations go to final day. That leaves no time for club physical…meaning that a glitch could occur and the window would close. Or if a club backed out because concerns from a physical, Tanaka would have very little time ot close a second deal.

    I know he took a physical in LA, but any club signing him would surely require their own physical by their own doctors…imo.

    I think that the latest that Tanaka will agree to a deal will be next Tues or Wed. They won’t wait until the last day or so because he has to take a physical and they don’t want a stressful situation. Good thing his agent isn’t Boras.

    A few random thoughts:

    (1) Why aren’t the Yankees trying to sign Micheal Young? I bet they are, it’s just real silent. Makes the most sense with ARod gone, and he will play full time if he signs. Perhaps a 2 year deal with incentives, with a $7-8 million base?

    (2) By air, LA is still 10 hours from Toyko, where NYC is 12 hours. Not that much flying time difference. Who knows why he chose LA? If Tanaka goes there, he goes. People in the ownership of the Dodgers are connected to Hollywood (Peter Guber is one of the five principal owners), so that may or may not help his wife.

    (3) Everyone thought Boston was an 80 win team this past year. They end up winning the WS. Historically, the best Yankee teams had strong CF and C–which they now have. Let’s see what happens, Tanaka or not.

    (4) At least ARod is gone. All of this nonsense will be on the back pages by ST.

    Good evening all… Finally made it from Portland to Salinas and to be honest, I’ve had my fill of the California traffic.

    So – Tanaka’s wife supposedly wants to settle in LA, Forsythe may or may not be a trade target, Arod has sued MLB and MLBPA (also considering suing the decendents of Abner Doubleday)… anything I’ve missed in the Yankee universe?

    I didn’t have the opportunity to sight-see (be back in a month, hope I can then).

    People were very, very, friendly… rained the entire time I was there… much larger city than I thought. Biggest take-away, though was the people… Oh, also – when I left, I was just getting used to other people pumping my gas for me :)

    Who knows if he’ll be the same ?

    Mike – MLB radio discussed the Holland surgery today… apparently Scott Feldman had the same type surgery…. I think they said it took him 11 months to return to action

    Young has been worth a combined -1.8 fWAR the past two years. -1.2 bWAR the last two years and -2 the year before.
